ORDERS ON THE WEBSITE WARTERFALL.PT
To place an order at WATERFALL, we offer three alternatives:
– Via the internet, via the website: www.waterfall.pt 24/24h and 7/7 days
– Via telephone/Whatsapp: (+351) 917384954 from 10:00-13 :00 and from 14:30 to 18:00 from Monday to Friday (subject to confirmation by email)
– Via email: firstname.lastname@example.org The customer will receive, by email, the confirmation of the order placed.
The photographs that illustrate the products do not enter into the contractual field and do not replace any commitment on the part of WATERFALL. On the other hand, with regard to technical data sheets and product descriptions, WATERFALL declines all responsibility for the possible existence of errors in its content.
The sales prices indicated on the website are in Euros, with taxes and fees included. Delivery costs, depending on the products ordered, are borne by the customer and are charged at the end of the order. These expenses will be automatically calculated by the system for certain countries. Note that, for the rest of the countries, delivery charges will be calculated and then confirmed by email to the customer. Waterfall reserves the right to modify prices at any time, however it tries to apply the current rates that were indicated on the website when the customer placed the order.
Waterfall respects the deadlines of an order as long as there is stock availability. In the event that one of the requested products is not available in stock, Waterfall will contact the customer by email or by phone within a maximum period of 15 days from the date of order, in order to inform the new delivery period. of product. However, if one of the ordered products is unavailable, Waterfall undertakes to offer its customer similar products at the same price. In case of refusal by the customer, Waterfall will refund the product if necessary.
Products purchased on the Site are delivered to European Union countries. Your order will be delivered to the address specified by the customer at the time of purchase. Waterfall offers 2 (two) delivery modes: Via regular mail, to the islands, and carrier to mainland Portugal, Spain and the rest of Europe. Each shipment is accompanied by an envelope containing the following documents: Original and Duplicate Invoice. Product deliveries are made on working days, without prior telephone notice, within normal hours. Deliveries are not made during non-commercial hours. As an indication, without this entailing any link to Waterfall and except for the unavailability of the products on the market or other possible causes of force majeure, the goods will be delivered in accordance with the following deadlines:
Orders will be delivered, by the carrier, within 4 (four) business days after we have received confirmation of payment for the same, or within 9 (nine) business days, to the islands through the post office. In case of non-receipt of the order within the indicated deadlines, an investigation will be made with the carrier, and it may take a few days. Large volume items, such as Kayaks, the minimum delivery period is 10 to 15 working days. The Customer must contact the Waterfall Customer Service and during this period no refund can be made, as the loss of the order will have to be checked and confirmed. The customer has the right, upon receipt of his order, to open the packaging to verify that the product is in accordance with what was requested and that it does not have external defects. In case the product is not the one that was ordered or has visible defects, Waterfall advises the customer to refuse delivery. When refusing delivery, the customer must write on the carrier’s guide what the problem was detected and return the product to the carrier, who will take care of the return. Within 24 hours, you must send an email to Waterfall’s “Customer Service”, indicating the problem detected. Once the package is delivered by the carrier, Waterfall is not responsible for any problems arising from the transport. Please note that Waterfall will be obliged to refuse any request for refund or replacement (right of withdrawal) for products that have external defects and that have been accepted by our customers at the time of delivery. The right of withdrawal remains valid for cases of technical problems that are detected by the customer after delivery and in accordance with the terms provided by law. What to do upon delivery: 1. Check if the package is in perfect condition. 2. Open the package asking the courier to wait for verification (this is a customer’s right). 3. Check that the product complies with the order made and that it has no visible defects. If everything is in order, accept the delivery. 4. In case there is any non-conformity, that is, an error in the requested product, or a visible defect, you must refuse delivery and fill in the detected problem on the carrier’s note. 5. Return the package(s) and all its contents to the courier (transport company). 6. In the case of deliveries by the carrier where the package has not been verified, the customer will have 24 hours to report the problem to our “Customer Service” by telephone 22 7838431.
Payment by bank transfer is subject to the following conditions: 1. The bank transfer must be made within 1 (one) week from the time the order was placed. After this period, the order will be canceled; 2. To simplify the processing of your order, whenever possible, do not forget to indicate the reference of the order at the time of bank transfer. 3. After making the bank transfer, you must send a copy of the proof to the e-mail email@example.com. 4. Once payment is confirmed, Waterfall will send the order to the indicated address, which may take 24/48 hours.
- At the end of the order, the customer will receive an ATM reference and the respective order value. 2. After making the operation at the ATM, and your payment confirmed, the order will be shipped.
Easypay payment (ATM, VISA and MASTERCARD reference)
- At the end of the order, choose the Easypay payment method and the necessary data will be available to pay for your order.
- If you choose this method of payment, Emboscada will automatically receive proof of payment and the order will be shipped.
WITHDRAWAL RIGHTS. SATISFIED OR REFUNDED
In order to exercise the right of withdrawal, the Customer will have to resend by registered letter, within 14 days from the receipt of the order, all the material received. This material must be new and complete (accessories, manuals…), and the products must be returned to us in their original packaging. This right of return can only be accepted for products in their original and complete condition (packaging, accessories, manual…) and in good condition. Products returned incomplete, damaged or used by the customer cannot be accepted. In case of exercising the right of withdrawal, Emboscada will do its best to reimburse the customer quickly, safeguarding, however, that this period will depend on the technical evaluations that will be carried out on the material, with a maximum duration of 15 days (counted on the arrival of the even to Ambush).
The user must return the product in the same package used in the first delivery. Whenever possible, the user should accompany the product to be returned with all original boxes, instructions/documents and packaging materials. The Seller will inspect the returned product. Any product that has been damaged, that is not in the same condition as the user received it or that shows signs of use beyond the simple opening of the package, does not entitle a refund.
The User will be responsible for transport costs (shipping and collection costs).
WARRANTIES AND AFTER-SALES SERVICES (SAV)
Every product sold benefits from a guarantee of conformity for a period of 2 (two) years from the delivery of the good. In case of non-acceptance of the repair, the manufacturer will establish a quote. The warranties of products sold by Waterfall do not cover: – replacement of consumables – abnormal or non-conforming use of the products.
– Use wetsuits for commercial purposes, rentals, schools, programs or activities that include instruction.
– Any other type of damage that is not derived from defects in workmanship or materials;
We ask that you carefully read the user manual supplied with the products, – faults related to accessories. – breakdowns and consequences related to the intervention of a company not authorized by Waterfall, – breakdowns and consequences related to non-compliant use of the product (professional, collective use…) – breakdowns and consequences related to any external cause. In any case, Waterfall cannot be held liable if the manufacturer refuses to apply the warranty. If you do not accept the quote established by the manufacturer, it may request the payment of administrative fees. If you agree with the budget, you must make a bank transfer corresponding to the budget amount.
LITIGATION AND LIABILITY
For the resolution of any and all disputes arising from the interpretation or execution of these General Conditions, the court of the place of the customer’s domicile will be competent. However, in the case of an action to be brought by the client, the client may choose between the court of his domicile and the Courts of the domicile of Waterfall. Waterfall is not responsible for delays or contractual non-compliance due to force majeure, disturbance, total or partial strike, postal services and means of transport or communication, flood, fire or war. Waterfall is not responsible for any indirect damage, loss of exploration, loss of benefit, loss of opportunity, damage or fees that may result from the purchase of any product presented on the website. Although our products have performances compatible with professional uses, Emboscada is not aimed at a professional audience. Waterfall cannot then see its liability compromised for any damage that is the result of a professional activity.
PERSONAL DATA PROTECTION
All content on the Waterfall Site (illustrations, texts, titles, brands, images, videos) is the property of Waterfall, its co-contractors or partners. The partial or total reproduction of the content through any procedure and in any medium is subject to the prior and express authorization of Waterfall. All information, content, documents and software offered by our services are protected by international law, with regard to intellectual property and copyright. Waterfall cannot authorize the copying, presentation or distribution of content that you do not have the intellectual property right. Any fraudulent use of rights obtained by third parties constitutes a counterfeiting offense, severely sanctioned by the Intellectual Property Code. Waterfall will in no way be responsible for a user’s violation of rights obtained by third parties and perpetrated by the latter’s activities on the site.
